Insurance companies and their lawyers have standard arguments against all injury claims. They often use these like a checklist: arguing even when their point is irrelevant or ridiculous. In this series, we will cover the most common B.S defences.
Fine at the Scene
It is common for the defence to point to the ambulance, police, or victim’s very first comments at the scene, and argue that these “prove” there was no injury.
Know anyone with cancer? Chronic back pain? Etc? When you ask: “How are you?” do they usually say “Fine”? Cancer cured? Back all better? Exactly. Actress Natasha Richardson fell and hit her head at Mt. Tremblant, Quebec in 2009. Husband Liam Neeson asked if she was OK. She said she was fine. Then she went unconscious and died of a massive brain bleed. She’s still dead. Not faking. Not “fine”.
Funnily, if the records from the scene say the victim was hurt, the defence argues those don’t prove anything.
