Seeing is Believing

Some injuries are invisible.  They may be emotional, psychiatric, or may be physical injuries which are hidden by your body.  But cases are won by proof.  How do we show these invisible injuries?

This case involved a pelvis injury, with damage to the spine.  Our client had surgery, bone grafting, and four large titanium screws permanently “fixing” her pelvic bones to her tail bone.  During an ICBC defence medical exam, the defence doctor broke her newly-repaired pelvis.  Another large, messy, dangerous surgery.  Now FIVE screws.  She would never again be able to engage in intercourse, carry a child, bear a child.

How to show that, when all the damage was “hidden”?.  We had a surgical modelling company cast an exact replica of her pelvis from MRI’s.  We had the surgeon who repaired her pelvis install the same screws in the model, exactly as he had in our client.  Those long needles?  Those were punched through our client to guide the screws into place.  Then we showed the model to the ICBC lawyer.

The case settled.  A long time later, the ICBC lawyer told us: “That model cost us a million dollars“.  It cost us a few thousand to have made.  And a lot of thinking to figure out how to show this injury.
